ACCEPTANCE OF RISK AND RELEASE OF LIABILITY

K9 Tactics (k9T) its owners, representatives, employees or volunteers shall henceforth be referred to as “K9T.” The above-named Canine shall be referred to as “Canine.” The above-named Canine’s owner/or authorized agent shall be referred to as “Owner.”

I hereby enroll the above noted Canine in the K9T facility for either boarding or training and this contract is valid from this date forward, for any time the canine is checked in or out of the kennel for boarding and training.

I/We, the owners of the above-named Canine, do agree and understand that there is always risk present within any activity involving ourselves and dogs. We understand and agree that K9T endeavors to mitigate all risks involved in the training, exercising, boarding and transportation of all dogs in their care, but that incidents involving ourselves and our dogs may occur, and we agree to release K9T and hold harmless its owner(s), employee(s), volunteer(s) or agent(s) from any responsibility and/or liability for injuries, conditions, illness, escape or loss of life to Canine that may occur during boarding, training or transportation.

I/We understand that the Canine(s) may experience the following risk (but not limited to) while in a board and train program and that we understand this is not due to fault or neglect: Extra physical stress

I/We understand this can mean the Canine(s) will burn extra calories and require additional caloric intake and possible nutrition adjustments, in order to maintain a healthy weight. This can also mean that the Canine may experience periods of adjustments where their weight may fluctuate during periods where we are slowly increasing calories to avoid digestive upset. I/We agree to provide a sufficient amount of food for the Canine(s) stay and agree to be financially responsible for the Canine(s) nutritional requirements during the full stay.

I/We understand and authorize K9T to implement their choice of training tools and techniques throughout the Canine(s)’ stay and training program. Further, I/We understand that these tools will all be used humanely and applied appropriately, as determined by K9T, but that even with careful use, some tools carry a risk of injuries, such as rub marks (such as muzzles, slip leads, collars, and other training tools), scrapes, pressure sores or scratches. All canines sent to K9T for training will be subject to socialization with other canines. K9T will take every precaution to ensure the safety of all the canines in their care however there is always a chance that dog bites may occur. Any minor injuries are tended to immediately and if at any time K9T determines vet care is required, the Owner(s) will be contacted immediately and vet care will be sought for the Canine.

VETERINARY RELEASE: K9T agrees to exercise due and reasonable care for Canine(s) for the duration of the contract. Owner agrees to release K9T and hold harmless its owner(s), employee(s), or agent(s) from any responsibility and/or liability for injuries, conditions, illness, escape, or loss of life to Canine(s) that may occur during boarding training or transportation.

I/We understand that K9T will contact the Owner should the Canine(s) require any vet care while in our care and preferably before transport to the veterinary clinic. I/We understand that should emergency care be required K9T may choose a clinic closer to the facility than the one noted above and the Owner will be notified of the change.

I/We give permission to K9T to seek and authorize veterinary care for the Canine(s) in the event that I/We are not able to be consulted prior to care being administered.

I/We understand that in the event that K9T should need to seek out veterinary care for the Canine(s) that the owners are fully responsible for all fees and may leave a card on file with their preferred veterinarian or in the case of an emergency with the veterinarian the canine(s) will be taken to.

I/We authorized K9T to approve medical care for the canine(s).

PERFORMANCE: The owner understands that K9T’s goal is to provide a Canine(s) that is well adjusted and well trained as specified within the details of each program, however, the Owner acknowledges that K9T, its owner(s), employee(s), or agent(s) make no warranties or guarantees, express or implied, as to the performance of Canine following the chosen training period.

CANCELLATIONS: Cancelations must be made 24 hours in advance to be credited your training session. If at any time the owner wishes to cancel past the training/program session there will be no refund for services.

RIGHT OF REFUSAL: After an assessment of a dog we have the right to refuse service to anyone if we believe the dog has been exposed to handler abuse in any capacity. Which includes malnutrition. If the dog has a known bite/aggression history which will fundamentally alter the nature of the services, programs, or activities provided to the public. Also no proof of current vaccinations will make your dog ineligible for our services.

In the unfortunate event of a dispute arising out of the terms and conditions of the contract, the venue shall lie in the courts of the state in which the service is provided. Each party shall be responsible for their own attorney fees and any other costs associated with this dispute including (but not limited to) court costs and retention of witnesses. Arbitration will be the means by which the dispute shall be reconciled.
